CBI’s limit is fixed: In Chhattisgarh, no investigation can be conducted against employees without written permission

The CBI will not be able to register a crime, let alone investigate, in any case without the prior written permission of the state government.

Now the Central Bureau of Investigation (CBI) will not be able to investigate, let alone register a crime against the government servants of Chhattisgarh, without the prior written permission of the state government. The state government has notified this as per the provision of the Indian Justice Code (BNS). The special thing is that the CBI will be allowed in the state that it will be free to investigate against the officials of the central government and public sectors anywhere in Chhattisgarh.

According to sources in the state government’s high ranking, the government has taken this step so that it can keep control over the matters related to its government servants. If this does not happen, the CBI can start an investigation and arrest any state official or employee based on a complaint related to corruption or any other criminal matter, but now the CBI will be able to lay its hands on state employees only when it will get prior written permission from the state government. Also, now it is clear that it will not be able to start an investigation, let alone arrest state government officials or employees in any case.

The state government has also laid down a condition for the CBI that no such investigation will be conducted in cases related to public servants controlled by the Chhattisgarh state government without the prior written permission of the state government, as is allowed in cases related to officers and employees of the central government or central undertakings. According to sources, now this central agency will be able to investigate only those cases which the state government will hand over to the CBI for investigation.

CBI will be able to investigate and take action against them

The State Government has given conditional consent for extension of powers and jurisdiction of members of Delhi Special Police Establishment to the entire State of Chhattisgarh for investigation of offences or classes of offences notified under Section 3 of the Delhi Special Police Establishment Act, 1961, as amended from time to time, which are alleged to have been committed by employees of Central Government, Central Public Sector Undertakings and private individuals, whether acting separately or in collusion with employees of Central Government Undertakings. This means that CBI will be free to investigate against the employees of Central Government or Central Undertakings anywhere in the State.
