New Delhi: The Supreme Court on Friday stayed the disqualification process of six Chief Parliamentary Secretaries (CPS) of the state appointed by the Sukhwinder Singh Sukhu-led government in Himachal Pradesh.
The Court stayed the Himachal Pradesh High Court’s direction that had declared the power to appoint Chief Parliamentary Secretaries and Parliamentary Secretaries in the state as unconstitutional.
A bench of Chief Justice Sanjiv Khanna and Justice Sanjay Kumar said no further proceedings would be taken in compliance with the Himachal Pradesh High Court order quashing the appointment of six MLAs as Chief Parliamentary Secretaries.
The court also made it clear that the state government will not make any further appointments as it would be contrary to law. The top court also issued notice to Bharatiya Janata Party (BJP) leader Kalpana Devi. Kalpana had approached the High Court against the appointment of Chief Parliamentary Secretaries. The court asked him to reply within two weeks and adjourned the hearing of the case after four weeks. The court has attached the matter to the petitions pending in the apex court on this issue.
