Rajasthan: Court granted bail to an accused in Kanhaiyalal murder case

Jaipur. The High Court on Thursday granted bail to Mohammad Javed, an accused in the tailor Kanhaiyalal murder case in Udaipur, Rajasthan. The accused had approached the High Court for bail after the National Investigation Agency (NIA) court refused to grant him bail in this heinous murder case that took place in the year 2022.

The accused, through his lawyer Syed Saadat Ali, argued that he was arrested on the basis of phone call details, while his location could not be traced along with other accused involved in the conspiracy. Ali said that before the incident, other main accused had gathered at a tea stall but the petitioner’s location was not there. No recovery has been made from him and his guilt in the case is yet to be proved, while the charges have already been framed.

Considering the arguments of the defence counsel, a bench headed by Justice Pankaj Bhandari granted bail to the accused as the arrest of the petitioner was based on the disclosure statement of him and other main accused in the case. In June 2022, tailor Kanhaiyalal was stabbed to death at his shop in the busy Hathipol area of ​​Udaipur. Kanhaiyalal was attacked by two men with knives. The accused were said to be angry that Kanhaiyalal had allegedly supported a post against Islam on social media. The incident had shocked the entire country. The case is being investigated by the NIA.

Charges were framed against the 11 accused in the NIA court in Jaipur under various sections of the Indian Penal Code (IPC), including 302 (murder), 452 (unauthorised entry), 153-A (promoting enmity between different groups on grounds of religion), 295-A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs), 120-B (criminal conspiracy) and the Unlawful Activities (Prevention) Act.
